Student's first admendment rights violated!

The lawsuit, filed Monday in a Florida federal court, concerns the student, now 19, who was suspended last year after creating a Facebook group about her English teacher. The group was called "Ms. Sarah Phelps is the worst teacher I've ever met!," and featured a photograph of the teacher, and an invitation for other students to "express your feelings of hatred." Later the student deleted this group, however, the school suspended her for three days and removed her from her advanced placement classes. How can this be? By creating this group she did not make any liable or slanderous comments or postings. Why was she punished? The first amendment says: "Congress shall make no law respecting... or abridging the freedom of speech..." The Congress is obviously not going to do anything about this, but regardless, that is besides the point. The first amendment allows for freedom of speech, thus exonerating this student.
